Terms of Service

Summary: Khidmat is a directory that connects you with service providers. We don't provide the services ourselves - we just help you find them. By using Khidmat, you agree to these terms.

1. Introduction

Welcome to Khidmat. These Terms of Service ("Terms") govern your use of the Khidmat mobile application and website (collectively, the "Service") operated by Khidmat ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of Service

2.1 What Khidmat Is

Khidmat is a directory and discovery platform that helps users ("Consumers") find and contact local service providers ("Providers"). The Service includes:

  • Searching and browsing service providers
  • Viewing provider profiles, ratings, and reviews
  • Contacting providers via WhatsApp
  • Saving and bookmarking providers
  • Submitting reviews and ratings

2.2 What Khidmat Is NOT

Important: Khidmat is NOT a party to any transaction or agreement between Consumers and Providers. We do not:
  • Provide, perform, or guarantee any services listed
  • Employ or control the Providers
  • Set prices or service terms between users
  • Mediate disputes between Consumers and Providers
  • Verify the qualifications or licenses of Providers (unless explicitly stated)

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

3.2 Account Types

3.3 Account Termination

You may delete your account at any time via the app settings. We may suspend or terminate accounts that violate these Terms.

4. Consumer Terms

4.1 Using the Service

As a Consumer, you may:

  • Search for service providers in your area
  • View provider profiles and reviews
  • Contact providers via WhatsApp
  • Submit honest reviews based on actual experiences
  • Save providers to your bookmarks

4.2 Consumer Responsibilities

You agree to:

  • Conduct your own due diligence before engaging any Provider
  • Negotiate terms, pricing, and scope directly with Providers
  • Resolve disputes directly with Providers
  • Submit only truthful reviews based on genuine interactions

5. Provider Terms

5.1 Provider Listings

As a Provider, you may create a profile to showcase your services. You agree that:

  • All information provided is accurate and up-to-date
  • You have the right and necessary licenses to offer your services
  • You will respond to leads in a timely and professional manner
  • You will not misrepresent your qualifications or services

5.2 Subscriptions and Payments

Providers may purchase subscriptions to access premium features:

Subscription fees are processed via Curlec (Razorpay Malaysia). By subscribing, you agree to Curlec's terms of service.

5.3 Cancellation and Refunds

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial billing periods
  • Credits purchased are non-refundable

5.4 Provider Responsibilities

You are solely responsible for:

  • The quality and delivery of your services
  • Compliance with all applicable laws and regulations
  • Obtaining necessary permits, licenses, and insurance
  • Paying all applicable taxes on your earnings
  • Resolving disputes with Consumers

6. Prohibited Conduct

You agree NOT to:

  1. Submit false information - fake reviews, misleading profiles, or fraudulent claims
  2. Harass or abuse - threatening, defamatory, or discriminatory behavior
  3. Spam - unsolicited messages, advertising, or promotional content
  4. Manipulate ratings - fake reviews, review exchanges, or paid reviews
  5. Impersonate others - pretend to be another person or business
  6. Violate laws - engage in illegal activities or promote illegal services
  7. Scrape or harvest - extract data from the Service without permission
  8. Circumvent security - attempt to bypass security measures or access unauthorized areas
  9. Interfere with Service - disrupt the Service or introduce malware

7. Reviews and Content

7.1 User-Generated Content

By submitting reviews, ratings, or other content, you:

  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content
  • Represent that your content is original and does not infringe on others' rights
  • Accept that reviews may remain visible even after account deletion

7.2 Review Guidelines

Reviews must:

  • Be based on genuine interactions with the Provider
  • Be honest and accurate
  • Not contain personal attacks, profanity, or hate speech
  • Not include personal contact information
  • Not be submitted in exchange for payment or incentives

7.3 Content Moderation

We reserve the right to remove or modify content that violates these Terms or our guidelines, without prior notice.

8. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by us and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or branding without authorization
  • Reverse engineer or attempt to extract source code

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.2 No Endorsement

Listing a Provider on Khidmat does not constitute an endorsement, recommendation, or guarantee of their services, qualifications, or reliability.

9.3 Third-Party Services

We are not responsible for third-party services, including WhatsApp, payment processors, or the services provided by Providers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • We are not liable for any loss arising from transactions between Consumers and Providers
  • Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or RM500, whichever is less

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any dispute between you and another user

12. Dispute Resolution

12.1 Between Users

Disputes between Consumers and Providers must be resolved directly between the parties. We are not obligated to mediate or resolve such disputes.

12.2 With Khidmat

If you have a dispute with us:

  1. Contact us first at support@khidmat.asia to attempt resolution
  2. If unresolved after 30 days, either party may pursue legal remedies

12.3 Governing Law

These Terms are governed by the laws of Malaysia. Any legal proceedings shall be brought in the courts of Malaysia.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting a notice in the app
  • Updating the "Last updated" date
  • Sending an email for significant changes

Continued use after changes constitutes acceptance of the new Terms.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

14.2 Severability

If any provision of these Terms is found invalid, the remaining provisions remain in effect.

14.3 No Waiver

Our failure to enforce any right does not waive our right to enforce it later.

14.4 Assignment

You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
